3. What Personal Information Do We Process, and Why?

The term “personal information” covers all information that can be used to identify a person, including but not limited to the person’s first and last name, age, gender, home or other physical address, phone number, email address, or other contact information, whether related to the person’s private or work-related information.

We use your personal information to improve our services, ensure the quality of our products and services, and manage our communication with you.

4. Visitors to TOWII’s Website

When you visit TOWII’s website, e.g., www.towii.com, TOWII processes information about your IP address and information about your computer, device, and browser. We also process information about your website visit, such as how you navigate the site, which subpages you visit, the content you view, your searches, and inputs, etc. Personal information is collected through cookies, log files, and other technologies. Our legal basis for processing is our legitimate interest in providing our website to you in accordance with Article 6(1)(f) of the General Data Protection Regulation (GDPR) or your consent under Article 6(1)(a) of the GDPR and Section 3 of the Cookie Order.

5. Landowners, Corporations, and Municipalities

When you are, or are considering becoming, a collaborator with TOWII as a landowner, company, or municipality, we process personal information about your name, (company) address, (work) phone number, (work) email address, your title, your land area, and other information you provide. This may be in connection with us buying/leasing your land, developing, constructing, and operating wind turbines or solar installations.

We process the personal information to fulfill our agreement with you, both concerning services we provide to you and services you provide to us. Additionally, we process the personal information to manage and nurture the relationship with our landowners and other collaborators.

Our legal basis for processing is the agreement with you, according to Article 6(1)(b) of the GDPR, or our legitimate interest in managing your information as a (future) landowner, according to Article 6(1)(f) of the GDPR.

Personal information about our landowners and other collaborators is kept for as long as the contractual relationship between the landowner or collaborator and TOWII exists. After the end of the contractual relationship, accounting material containing personal information is stored in accordance with the Bookkeeping Act for a subsequent period of 5 years from the end of the financial year to which the accounting material relates. Other personal information in, for example, the contract is stored for 10 years after the end of the contractual relationship.

6. Neighbors and Other Stakeholders

When you contact us via email or phone or participate in our neighbor meetings, we process the personal information about you that you provide.

The purpose of processing this personal information is to service and assist you with your inquiries.

The legal basis for our processing is our legitimate interests according to Article 6(1)(f) of the GDPR. The legitimate interests we pursue are handling your inquiry and providing general service to neighbors and other stakeholders.

The information is stored for the time necessary for the fulfillment of the purpose. However, the information may be stored longer if necessary for the establishment, exercise, or defense of legal claims.

7. Suppliers

When you are a supplier to TOWII or a contact person for such, we process personal information regarding your name, work phone number, work email address, publicly available information, and other information you provide.

We process the personal information for contract management and to receive goods and services from our suppliers.

Our legal basis for processing is the agreement with you, according to Article 6(1)(b) of the GDPR, or our legitimate interest in managing the relationship with you/the company you represent as a supplier, according to Article 6(1)(f) of the GDPR.

Personal information about our suppliers is kept for as long as the collaboration continues. After the end of the collaboration, the information is stored in accordance with the Bookkeeping Act for a subsequent period of 5 years from the end of the financial year to which the information relates.

8. Sharing Your Personal Information with Others

TOWII may disclose your personal information to suppliers and/or service providers as part of our normal business operations but only within the limits of the law.

TOWII may also disclose your personal information to a public authority in situations where we are specifically obligated to disclose your personal information in accordance with the law. We limit the disclosure of personal information as much as possible.

TOWII transfers your personal information to data processors as necessary. Our data processors only process your personal information for our purposes and according to our instructions.

9. Transfer of Personal Information to Countries Outside the EU/EEA

In connection with our processing of your personal information, we may transfer the information to countries outside the EU/EEA.

Data protection laws in these countries may be less stringent than the laws in Denmark and the rest of the EU/EEA.

If we transfer to insecure third countries, the transfer of your personal information will be based on the standard contractual clauses (SCC) set by the European Commission, specially designed to ensure an adequate level of protection, or on other secure transfer bases.

We will assess from time to time whether the transfer basis is sufficient and, if necessary, adopt additional measures to ensure an adequate level of protection for the transfer.

From time to time, it will be necessary to update this privacy policy. We regularly review our privacy policy to ensure that it is up-to-date, valid, and in accordance with applicable laws and principles for the processing of personal information.
